This is my question. The trademark goes by the application date/date of first use. They applied in 2018 but it was suspended until 2023 when it was registered in 8/23. So when Chloe created her business name if she did a trademark search there wouldn’t have been a registered trademark at that time. I feel like there should be some sort of time limit after an application is applied to prevent issues like this?

I really don’t understand what they were thinking coming after someone so beloved. Does the fact that Chloe sexton has millions of followers and they don’t have any sway in the matter? The media that has been found about them makes them quite unlikeable imo— so in the court of public opinion I think they’ve lost.

Chloe herself said the problem was with any name that contained Chloe Cookies, in any combo. I don’t think she said she was being sued. I think she indicated people were trying to make her stop using the name. I think people just assumed it was suing. I think she maybe tried to get out ahead of possible social media attacks by the people asking her to stop using her name. But understandably she isn’t giving super clear details. I think the dust will have to settle before we know the full story, if we ever know. I have appreciated your insight from your experience dealing with the legal side of stuff.

The two companies aren’t in close proximity. They’re not in the same town, state, etc. Neither are a franchise or have multiple locations. No one would go to “Chloe’s Cookies” in one state and confuse it with “Chloe’s Giant Cookies” in a totally different state. Doesn’t that matter? Wouldn’t “Chloe’s Cookies” have to go after every single business with the variations of that name to make this make sense?

From a consumer perspective Chloe’s cookies could be anyone. Chloe’s giant cookies is a well known name so I don’t think it would be confused for Chloe’s cookies but I think Chloe’s cookies could get mistaken for her.

Purchasers know it’s Chloe physically and by name. Her story is extraordinary. It’s her face & her story that brought consumers to her cookies in hopes to relieve her of financial stress during a hard time. It wasn’t the actual search of a general cookie named similarly. If anything, if the opposing company had a boost in sales in that same time period without added marketing, would they not be benefiting by her? 💝 Sad to hear her story is now taking on negative publicity. She’s been through so much.
