Utah Man Released on Bail After 41 Years in Custody as New DNA Evidence Raises Questions At 71 years old, Douglas Carter walked out of a Utah jail after spending 41 years in state custody, much of that time on death row. His release came after newly analyzed DNA evidence raised fresh questions about the murder conviction that had kept him behind bars since 1985. Carter was convicted of killing Eva Olesen in 1985. Olesen was the aunt of Provo’s police chief at the time. Carter was sentenced to death that same year, and his death sentence was imposed again following a retrial in 1992. Over the decades, Utah courts rejected numerous appeals. Throughout his imprisonment, Carter maintained that he was innocent. He also argued that the confession he signed had been coerced. According to his defense attorney, Neal Hamilton, the evidence in the case had not undergone DNA testing before June 2026. In September 2026, newly analyzed DNA evidence from the crime scene produced results that could affect the case. Blood found on a doorknob and genetic material recovered from the knife handle did not match Carter. Following the results, Utah County prosecutors withdrew their plan to seek the death penalty. On September 28, Judge Derek Pullan ordered Carter released on bail despite objections from Olesen’s family. Carter must wear a GPS monitor while awaiting a new trial. However, the DNA findings have not settled the question of guilt or innocence. The judge said the new evidence further weakened the case against Carter but also noted that a reasonable jury could still conclude that he committed the murder. Prosecutors have emphasized that the DNA results alone do not establish Carter’s innocence. Olesen’s family has said it will not comment on whether any individual is guilty or innocent. Hamilton described the toll of Carter’s long imprisonment as 41 years of “state-induced trauma.” After spending more than four decades in custody, Carter now faces the prospect of a new trial while adjusting to life outside a jail cell. The case, which began in 1985, remains unresolved. The new DNA evidence has reopened questions about the conviction, but the final legal outcome—and the full truth about Olesen’s killing—are still to be determined. #utah , #dna , #evidence , #wrongfullyconvicted , #deathrow
