If he observed her holding her phone in her hand, which she admitted to because you can’t put it down without holding it, then he can be led to believe she was using her phone in her hand. I understand her desire to argue in circles. But if a police officer can see you through the window of your car and your phone is in your hand and it is illegal to have your phone in your hand you are guilty. It doesn’t matter if the phones on or off active inactive.
