And Biden’s administration could have taken steps to investigate or seek release of Epstein-related records if there were evidence implicating Donald Trump, but there were important legal limits. * The FBI and DOJ were under Biden’s executive branch, so Biden could direct the Justice Department to prioritize an investigation, and DOJ could investigate anyone—including Trump—if there was sufficient evidence.
