Eligibility for an IEP is not based solely on grades, test scores, or whether a child is passing classes. The law looks at educational impact and whether the disability creates a need for specially designed instruction to access education. Education is much broader than a report card. Educational impact can include things like difficulty with attention, executive functioning, behavior, regulation, communication, social interaction, or the ability to participate in instruction throughout the school day. A student may be earning passing grades while still struggling significantly to access the curriculum, keep up with expectations, regulate in the classroom, or demonstrate what they know. Sometimes students compensate. Sometimes parents provide extensive support at home. Sometimes teachers modify informally. None of those things mean the disability is not impacting education.
