I have worked with people who often confuse the correct pronouns as their mother tongue doesn’t have pronouns. I wonder what would happen if they got accused of misgendering when it isn’t their intent

I understand both sides being consistently misgendered as the mental health ramifications can be awful. But I understand the disability and not remembering or recalling the information quick enough. Aslong as it wasnt on purpose and being hateful.

Absolutely correct judgement by the tribunal. However disappointing that she was put through a disciplinary for pronouns (or feelings). If done with malice yes there's an issue if not, move on 🙄.

I would be interested to know whether the claimant misgendered the individual consistently, or whether she often used the correct pronouns. If the misgendering occurred every time, that might raise questions about intent. However, if it was intermittent rather than constant, it would appear more likely to be unintentional and therefore better understood as a manifestation of the claimant’s disability rather than deliberate conduct.

Another interesting case, Belle, thanks. It almost beggars belief that a university could make such a basic error. You might understand a lay person being distracted by the gender identity issue, but for a university's HR department to make such a basic mistake is very surprising, to put it at its lowest! 😁🫶
