I would be interested to know whether the claimant misgendered the individual consistently, or whether she often used the correct pronouns. If the misgendering occurred every time, that might raise questions about intent. However, if it was intermittent rather than constant, it would appear more likely to be unintentional and therefore better understood as a manifestation of the claimant’s disability rather than deliberate conduct.

You might understand a lay person being distracted by the gender identity issue, but for a university's HR department to make such a basic mistake is very surprising, to put it at its lowest! 😁🫶
