The U.S. government is finally investigating Somali-born Ilhan Omar’s immigration history. Here are the 3 main issues: First, Omar says she derived citizenship in 2000 as a minor through her father, but that only works if she was still under 18 at the time. For years, Minnesota records listed her birthdate as October 4, 1981. But in 2019 — after people started asking about it — Omar’s congressional staff asked the state of Minnesota to change her birthdate to October 4, 1982. This matters because she was too old to derive U.S. citizenship as a minor through her father if she was in fact born in 1981, not 1982. Diligent searches have turned up no naturalization records for her father under the names that have been used, but let’s see what turns up now. And by the way, knowingly procuring naturalization contrary to law is a felony punishable by up to 10 years in prison, fines, and automatic revocation of citizenship. Second, in 2009 Omar married a British citizen named Ahmed Nur Said Elmi, and critics have claimed for years that Elmi is her own brother and the marriage was solely for immigration benefits. Public records show they separated around 2011, but she didn’t finalize the divorce until 2017. The whole time she was with another guy named Ahmed Hirsi and had a child with him while still legally married to Elmi. Naturally, Omar has denied marrying her brother, but she has never released the immigration records that would clear it up. Why do you suppose that is? Third, Omar’s father was a colonel under Siad Barre — the dictator whose regime carried out mass killings in Somalia. Reporting has raised questions about whether that military background was fully disclosed when the family sought refugee status. If he willfully concealed material military service on his refugee application, that could render his status (and any later naturalization) improperly obtained by fraud, which could also strip derivative citizenship from a child—like Ilhan Omar—who claimed it through him. I’m Joseph Bovino, U.S. immigration and business attorney based in Florida and serving clients worldwide who are basically the polar opposite of Ilhan Omar and everything she stands for.
