I'm not an expert but allegedly you are.

Depends on scheme rules.
Some are binding and you have to pay to ex wife's or partners others the trustees can decide

Raj :
But again it is up to the Trustees to make the decision and sometimes they can even decide not to pay it at all

what happens if no one is nominated through expressions of wish, does it then revert back to the will or does it automatically go to next of kin???

Will they sit inside the Will when they change IHT legislation to include pension funds?

Mela Montauro Jackso :
When my dad passed away and left his Pension to my mum, we needed it for her care but the Pension guy said it’s too much money to release and gave it to her a monthly instalment which we struggled to pay for her care and then she passed away and they kept a quarter of £1 million because it went to the trustees which is why I won’t be paying into my pension and more and putting it in my ISA

This is correct, it's very useful to have. However, it's important to note that it's not binding on the pension provider. In most cases, they will still have a discretion and can award the benefits to other beneficiaries and/or in different proportions than those stated on the Expression of wish.

Also check it with your work if you have death in service benefit. I work in HR and have seen this happen many times, sadly.

So the pension pot is one asset that will never escape IHT unless you buy annuities or leave it to your spouse (assuming it is greater than £325K)?

This is exactly what I needed to know for my father. He's not good with this stuff but he wouldn't want his pension going to his ex (my mum).

I thought if you die and your children are adults then the pension dies with you. One Reason for taking a lump sum when you retire and after that you can leave it with who you want

It’s the same for a death in service payment. I got my staff to complete the expression of wishes forms to ensure the info was communicated to the insurance provider.
