hat wouldn’t actually work the way it sounds. Even if a federal trademark registration lapses, the original business usually still has common-law trademark rights because they’re actively using the brand in commerce. If someone else files just to grab it, it can be challenged and cancelled for bad faith through the United States Patent and Trademark Office. You can’t realistically “own their whole brand” just because they missed a renewal, and trying to pressure them for royalties could create serious legal trouble.

you can actually do something similar with property if someone isnt paying their property tax, you can pay it for them, if they dont pay you back within a certain amount of time the government will give you ownership of that land

As someone that own trademarks, you need to prove you have been using the trademarked for a good amount of time …. Before you can claim it. Also no one should have used it before you in the same industry.

this happened pizza hut a few years ago. their domain was up for renewal and someone scooped it up for penny's. think they had to pay a million to get it back. crazy

you can sue someone who legally registers your company name, especially if they are doing so in bad faith to profit from your reputation or coerce payment
