umm excuse me. if the customer left it in the shops care they assume the liability of it and should replace the vehicle and worry about its money back with the driver and mechanic that was driving it.

Jordan Kenneth Thoma :
My issue is how does an insurance company get to contradict the police report police says the other driver was 100% at fault and the insurance says naw only 70% insurance is a freaking scam

So the dealer replaces the car, and sues the other driver/insurance if needed.

an oil change does not require a test drive so what kind of warranty work did require a test drive? because not all warranty work requires test drives

Doesn’t matter the dealership fixes the car and then subrogates their expense with the at fault insurance

Ace :
Dealership is not at fault, however if it happened while their employees had custody of the vehicle they should make things right.

She needs to file with her insurance and let them battle it out she probably has an off the wall insurance co. Allstate fought my battle and got their $ back

if the insurance found them 30% liable, then the dealers options are to challenge it or pay for 30% off the damage. it's not the owners responsibility to go after anyone for the difference when the car was left in the dealers care.

firat off, if it's a total loss there are no repairs to be made. Allstate should be in contact with the dealerships insurance not the dealer directly. The dealer can say what they want but it is between the two insurance companies. If the insurance companies dont agree, they will end up in arbitration to come to a final ruling. Good luck in getting the total loss handled quickly.

The worst part is that even if Allstate accepts 100% fault, they are probably going to pay her the cash value of the car. Chances are she is either upside down on the loan or unable to recover for the money she put down at purchase.

Another reason I won’t use Allstate. They don’t fully insure their drivers. You’re asking for a lawsuit

People really don’t know how insurance works. Zero responsibility on the dealer. Insurance companies are for-profit ventures. Of course they’re trying to reduce liability. It’s part of the process where no one wins but the lawyers
