Political parties and candidates will have 36 hours to publicly retract and correct false or misleading information under new rules introduced by the Electoral Commission of South Africa (IEC) ahead of the 4 November 2026 Local Government Elections. The new Disinformation Code, gazetted on 4 September, applies to election-related communication both online and offline, including content published by parties, candidates or people acting on their behalf. The rules require parties and candidates to verify information before sharing it and to take reasonable steps to publicly correct false or misleading information once they become aware of it. The code also targets deceptive election tactics, including fake accounts, bot networks, coordinated inauthentic behaviour, doxing and cyberbullying. AI-generated or “synthetic” content must be clearly labelled before distribution, while political advertising must identify who is responsible for it. The IEC stressed that the rules do not prohibit legitimate political debate. Lawful criticism, opinion, commentary, fair reporting, satire, parody and legitimate democratic debate remain protected where they constitute protected speech.
