Real estate agent here. Paying an assignment fee, certainly isn’t fraud. I just bought a property through a wholesaler, and paid a $20k assignment fee on a $140k purchase, all done legally through an attorney, with disclosures on my end, that I am a real estate broker, and acting in my own best interest. Things get a little murky with the proof of funds portion. I assume this site mentioned, uses hard money? And there is some form of underwriting on the numbers? It sounds more like a pre approval, under the guise of proof of funds. Probably not illegal (not an attorney) but disingenuous, in that proof of funds is supposed to mean that the funds are currently held, and readily accessible. If it works, it works. No shade from me

It’s not fraud on your side necessarily. It’s more to do with the real estate licensee. Legally real estate agents are required to have funds go through their broker and then the broker pays them.

It’s the same as buying for a corp and putting “or assignee” under the purchasers. In your case you just don’t know who the buyer is it. Who cares, if the property sells the seller should be happy.

As a mortgage broker I offer the same “loan”. “We” the lender give cash to the sellers, “we” the lender then give a loan to the buyer. The reason you can’t get a loan upfront is, form the looks of it these homes need work, or you want to just go in as a cash buyer to have more power.

It’s only fraud if you do it in very specific wrong ways. But there’s nothing illegal about finding good properties, negotiating good terms like you’re going to buy it, getting it under contract and in escrow with earnest money deposit, then saying “hey I changed my mind I don’t want to buy it, but this guy will” and collecting the fee…

Only proof of funds my clients accept is bank statement from buyers bank with their name & account # on it. Now if they are doing loan then pre approval from lender and then I call lender to verify. Those are only two bonafide POF

You can pay him a fee, but how he receives the fee can be be practicing real estate without a license. Has to be done right. POF is another explanation

I did wholesaling for a bit and it took me a minute to find a realtor to work with me but once I did, that Realtor saw how easily things went so then they started sending me similar deals. It’s not illegal.

The key detail they’re mistaken on is that REALTORS cannot pay a “finders fee“ to someone who isn’t also licensed lol nothing illegal about an unlicensed individual to pay another unlicensed individual. However, some of the people that find deals for you I can assure you are illegally misrepresenting themselves to sellers in a lot of cases 😅
