in austria and germany it is a rule its in the law using a wrong crest means "wappenschwindel" if someone else is the rightfull owner he can say u arnt allowed to use it. But if u have rare name ur prettymuch safe, if u have a common name and just copy some random crest u found its probably not urs. But u can create a new crest if u like there are some companies that do this. (if u have a coat of arms at home inharritet chnaces are pretty good u are the rightfull owner so dont botter spening lots of money and time in research) but most of the #wappens chwindel" was in the 19 and 20hundrets... but honestly nowadays noone realy cares because the crests and coat of arms are cool and boring old rules suck.
