Part 2: Councilwoman Blows OVER DOUBLE THE LIMIT After DWI Arrest: Around 10:32 PM on September 6, 2025, Officers Vincent Fischer and Kevin Pisano with the Denville Township Police Department were stopped at a red light at Route 46 East and Route 53 South. They performed a random plate check on a white 2021 Acura, and learned that the vehicle did not have a valid registration. They initiated a traffic stop, and the driver pulled over on Route 53 just south of the Route 80 overpass.  The driver of the Acura was identified as Toshiba Foster, a Democrat who serves as a Councilwoman in Morristown. As they started speaking with Toshiba, the officers detected the odor of alcohol and observed other indicators of impairment. Toshiba told the officers that she was headed home after coming from a friend’s house. Based on their suspicion of impairment, Toshiba was asked to exit the vehicle and perform field sobriety exercises.  The first exercise was the Horizontal Gaze Nystagmus (HGN) test. The second exercise was the Walk and Turn test. During the Walk and Turn test, Toshiba did not touch heel-to-toe on each step, took an incorrect number of steps, and turned improperly. The third exercise was the One Leg Stand test. During the One Leg Stand test, Toshiba failed to raise her foot in the proper fashion and did not keep her arms at her sides. Based on the odor of alcohol, her indicators of impairment, and her inability to satisfactorily complete the field sobriety exercises, Toshiba was placed under arrest for driving under the influence. A search of her vehicle incident to arrest yielded multiple sealed bottles of Prosecco wine. Her vehicle was impounded for a 12-hour hold according to John’s Law. Toshiba was transported to the Denville Township Police Department for further processing.  At the station, the Standard Statement for Motor Vehicle Operators was read to her, and she agreed to submit breath samples. Her Alcotest results indicated a BAC level of 0.20%, which was more than double the legal limit of 0.08%. After the officers finished processing her, Toshiba was eventually released to her daughter pending her court appearance. #cops #fyp #police
