So, lawyer here. It doesn’t really matter so much anymore. Many jurisdictions are starting to ramp up common law rights. In many cases it’s indistinguishable. Spousal support, child support, asset breakdown, it’s all becoming the same, for this exact reason. Always consult a lawyer, always have the hard discussion before anything. The most important thing regardless of common law or legal registered marriage, is making sure there is an understanding of your assets, how they are held, and who has access to them.
