@diana_talks_realestate: If you’re a homeowner in California thinking about renting your property short-term before selling… you need to hear this. Many owners assume that once a lease expires, the tenant has to leave. That’s not how it works anymore. Under California’s no-fault eviction rules, even if your lease ends, your tenant may have the legal right to stay and removing them can become expensive, time-consuming, and complicated. In many cases, if you want your property back to sell it vacant, you may be required to: • Provide a legal “just cause” reason • Pay relocation assistance • Follow strict notice timelines • Navigate tenant protections that heavily favor occupancy This can delay your sale, reduce your buyer pool, and in some cases, force you to sell the property with a tenant in place—often at a lower price. And here’s the part most homeowners don’t realize: 👉 Renting “just for a few months” can turn into a long-term situation you can’t easily control. If you’re planning to sell in the near future, you need to think twice before leasing your home—even short-term—because getting the property back is not as simple as waiting for the lease to expire. This is one of the biggest mistakes California homeowners make right now. #CaliforniaRealEstate #LandlordTips #TenantRights

It’s also important to note that you can choose to not renew the lease (after the lease contract ends) if your property is AB1482 exempt. So in that case, you’d be able to have the tenant leave and you can sell the property.

Fantastic advice, especially for LA and San Diego County. Currently in California, sell your rental property and do a 2031 tax deferred exchange to purchase a property in Nevada or Arizona

This applies mainly to multi family. But the county just passed a 2 month non payment of rent before you can evict and it’s two months of market rate rent so could be longer if your rent is below fair market value.
