I disagree. The court would in my opinion find in the drivers favor. The officer clearly said that he was giving a citation in lieu of arrest. Only after having laughed did the officer decide to arrest the driver.

Look it up; federal court of appeals overturned a Florida case and it has stood as law ever since! The court opinion stated drivers flash lights for an assortment of reasons; warning drivers of wrecks, obstructions, animals on the road and numerous other warnings of hazards!
