the thing is, judges are given so much discretion and immunity, because becoming a judge in the first place is supposed to be extremely selective and only given to those who have outstanding moral judgement and personal character. in our modern political realm, any and every office of government, no matter how minuscule, has become a political game.

I really believe that nobody is 100% unbiased. Sure you might try to hear both sides but still at the end you take decisions based on what you know

My undergrad constitutional law professor had this philosophy and we wrote biographies on SCOTUS using their personal lives to understand their decisions

You get it exactly right every time. My recurring thought in con law is that claims of objectivity in the law are, at best, DEEPLY contestable.

The idea that judges and justices have a worldview they bring to the cases is not new. 99% of people recognize that. The better question is…what would you change? Right now, the steps are to have a president nominate someone and then have them endure confirmation, and then to give them a lifetime appointment to insulate them from having to campaign or please anyone in a political way. What change would you make to reduce bias in the courts?

We make every attempt to be objective. Yes it is impossible. But the attempt is what matters.

One of the biggest frustrations to me are that Supreme Court Justices do not have to adhere to the same rules and regulations as lower level courts. I understand why that is. Lower level courts were created from legislation, and the Supreme Court was the only court created by the Constitution. Requiring the same standards of Supreme Court Justices would require a constitutional amendment. Currently our only recourse is impeachment, which is probably impossible right now.

Look into the constitutionality of punitive damages, idk if you can confidently say they’re trying to be objective

If the legal field wants to continue with meaningful efforts of biased people making "unbiased" decisions, there should be an acknowledgement of that fact. No one can educate themselves out of biases or personal experience. Robots aren't even exempt from this, because as of now, a real person designs the robot software.

I know you just said you think this is bullshit, but why is this even a thing. For poor people in the crim justice system, they always use your personal posts and words against them? Do you think judges should capped by term limits?
