@bellethelawyer: Changing a disabled employee’s hours can be discrimination. This worker relied on a 5am start to manage autism and anxiety. The employer refused to properly consider adjustments — and it cost £12,925. #lawyer #employmentlaw #employee #employer #employeerights
How do you properly document things like these as they occur? It’s something easily lost track of as neurodivergent

Thanks, Belle. Another interesting case with an easily predictable decision. The Royal Mail has never been in the vanguard of good employment law practices, and this goes to show they've not improved over the decades. A small employer might just be excused a misjudgement like this but for such a large employer to make such a basic error is unforgivable.✌️

80%of our workforce is protected under equality act 2010. reasonable is the key, however we have an emergency service to run. being fair and consistent, them becomes a challenge.

Can you have the same rights as a contractor based on this case ? Or is it only for a permanent member of staff ? Some contracts for contractors do go on for years and years.

Royal Mail sacked me the day my mam died because I didn’t go in despite me ringing the absence line at 8:30am as soon as the line opened. I was also 29 weeks pregnant

I personally don’t think calling someone with anxiety ‘disabled’ is fair to the disabled community. It’s gone too far, even if I agree this man should have been accommodated. Employers will now act to avoid hiring these people and they’ll hide it

your point about it not being the adjustment but the fact that the employer didn't even bother exploring adjustments... this is exactly it and something I come up against a lot as a work coach for autistic people. so many employers don't even want to think about it, like seriously do you want to get in trouble with the law for discrimination? because disregarding disability and not even considering the options is how you get in trouble with the law

Why she trying to explain it like they’ve committed some awful crime. Employers manage the schedule if they say they do t want him in at 5 he’s not starting at 5. I really don’t see the problem
