Police officers use discretion all of the time.The police don't arrest every person that they stop.The police definitely don't arrest a fellow officer even if they're drunk driving, So don't say police can't unarrest somebody

As of 2026 Alabama is not a stop and ID state. Current Status: As of early 2026, the Alabama Supreme Court was hearing arguments on whether officers exceeded their authority, a case that could redefine police powers and the "Stop and Identify" law in Alabama. Shame on this police dept. their egos got in the way.

Once they arrest you (especially when its an unlawfull arrest) its better that they keep you arrested so that the paper trail of an arrest is most strong for the lawsuit
