I give up. I absolutely give up. Why can’t we just say, hey you’re gonna get my house, pay the rest of my taxes pay my bills get them cleared and you can have the proceeds from the house. They make it so absolutely complicated and so expensive to set up a trust.

If your name is on your spouses accounts or investments, you still get that correct because mine is my husband and if he’s gone, then it’s my boys 50-50 same as my husband’s where it’s me and then our boys 50-50

a small estate affidavit may also be a good option. the limits and waiting times vary by state, but it's one way to claim assets in a situation like this when there are no co owners, beneficiaries or trusts

I did this with one child and it's written in my will that it's understood that all 3 get an equal share. Each child has a specific role in my elder care/death and they are fully aware of all of it. Planning ahead makes it easier for them so they can just get through it quickly without fighting a bank in court.

One thing I just realized my mother had stuck me on her bank account and when she pass I received a letter from social security telling me that they wanted information about the children that my mother had because she had a check that was owed from social security that they did not put in to her account when I notified them that she passed away So now they were wanting to divide it up among the children that would have never been my mother's wishes especially one of the children who she had no contact with for many years I asked them why didn't they just put it in her account because that's what she would have expected and I was her caregiver and I was on her account and she also lived with me and they told me that's not what they do They withhold it and then they send it out to the children evenly how is that even allowed
