@bellethelawyer: This is a clear reminder that even where misconduct is established, employers must still follow a fair process — especially where disability is in play. #EmploymentLaw #UnfairDismissal #HR #lawyer #employeerights
What adjustment can you really make in this scenario?

This isn’t about him not being punished it’s about dismissing someone without proportional disciplinary steps prior to dismisal

i think that had they done that investigation he would have still be dismissed, its not the dismissal that was wrong but the missing steps that lead to it meant that it wasn't done correctly

Soon as you get served papers their only objective is to dismiss

You did another video that said it wasn’t intent that was important, but how it is received. This sounds like a situation where the employer is responsible either way and can’t win. If they don’t remove the person the victim can sue and if they do then the speaker can sue.

This has happened with me. Although I didn’t actually do anything. But their framing my “misconduct” as relationship breakdown and dismissed me. No investigation of allegations and no investigation of link to my disabilities

I have ADHD and I’m an LSA for many students with ADHD, making inappropriate sexual comments has nothing to do with ADHD in any way and never has. They didn’t consider the ‘link’ because there isn’t one.

I wonder how the victims would feel about this as it seems like multiple times over and over is more than just because of the disability

I think tribunals need to start asking for evidence about said disabilities

As someone with it, it is extremely annoying when people use it a defence. And even more annoying when other people without it believe that it is an actual defence.
