Depending on your state laws, the ring is consider a gift, but in some states you don’t have to return the ring if the person who gave the ring calls off the engagement. If the person who receives the ring calls off the engagement, they have forfeited a possible contract and they have to give back the ring.

NO-FAULT States: Most states, including New York and New Jersey, follow a "no-fault" rule. In these states, the ring must be returned to the giver if the wedding is called off, regardless of who ended it. FAULT-BASED States like Texas and California, the court may consider who was at fault for the breakup. Recipient at fault why have to return the ring. Giver at fault the recipient may be able to keep it. HOLIDAY GIFT: If the ring was given on a specific gift-giving holiday (like Christmas, Valentine’s Day, or a birthday), the recipient may argue it was an unconditional gift. The MONTANA Supreme Court has ruled that engagement rings are unconditional gifts, meaning they generally do not have to be returned. FLORIDA: The ring typically goes back if the breakup is mutual or initiated by the recipient.

States have different laws. In some states IF the woman breaks off the engagement the ring is supposed to be given back. If the man breaks if off she keeps it.
