For those who keep asking: No, they are not able to sue FedEx. Why? Because small package drivers are not ACTUAL FedEx employees. Drivers are actually employed under a 3rd party contractor companies that are privately owned/RARELY corporate owned. The only thing this does to FedEx is discredit them VERY BADLY. Even if the parents tried to sue, its not going to bring thier baby back. Should they sue FedEx? No, this is not on them. Should they sue the contractor? Yes AND no. Drivers are under the DOT Law, meaning you HAVE to have a clean record to drive an authorized vehicle (Logistics 101). How do I know this? Im an ex-FedEx worker and use to speak to the actual contractor owners from my old warehouse about the rules of it all.
