The fact that this can happen is an indictment of capital markets. This has no relationship to the efficient amalgamation and allocation of capital, but Avis should absolutely issue shares sufficient to cover the shorts at the inflated price, pay off their debt, and make sure that their employees still have jobs tomorrow. But it won't, because a board member controlling a vast number of shares has a total conflict of interests because his fund's short term interests are totally at odds with the company's (and thus the minority shareholders') long term interests.
