@dankimtheking: In Kenya, "The Law" isn’t just for landlords—it’s there to protect your pockets too. Here are 4 times a Landlord can be ordered to pay YOU compensation: 1. The "Self-Help" Eviction (Changing Locks) The Law: A landlord cannot kick you out without a court order, even if you owe rent. The Case: In Mombasa Case (2022), a developer forcefully evicted a tenant. The court ordered the landlord to pay Sh62 Million for damages and loss of business. Point: If they throw your stuff out or change locks, they owe you "General Damages" for humiliation. 2. Cutting Off Water or Electricity 💡💧 The Law: Disconnecting utilities to force you to pay or leave is "Constructive Eviction." It is illegal under the Rent Restriction Act. The Case: Tenants in Nairobi have successfully sued for "Inconvenience." In one instance, a landlord was ordered to pay Sh50,000 just for a 3-day water disconnection. 3. Withholding Your Deposit Unfairly The Law: Deposits must be returned within the timeframe in your lease. Landlords CANNOT deduct for "normal wear and tear" (like faded paint). The Case: Tribunals frequently order landlords to refund the full deposit plus the legal costs of the case if they can't provide receipts for genuine repairs. 4. Selling Your Property Without Notice The Law: If a landlord auctions your household items without following the Auctioneers Act (missing the 14-day notice), they are liable. The Case: If your items are sold illegally, the landlord (and the auctioneer) can be ordered to pay the replacement value of everything sold plus damages. ⚠️ PRO-TIPS FOR TENANTS: Document Everything: Take photos of the house when you move in and out. Demand Receipts: Never pay rent or deposits in cash without a signed receipt. The Tribunal is Cheap: You don't always need a lawyer for the Rent Restriction Tribunal; filing a case is affordable! #LegalAwarenessKenya #TenantRightsKE #NairobiRentals #RentRestrictionTribunal #KenyaLaw Should I list the specific documents you need to gather before filing a case at the Rent Tribunal?

This applies in theory at the Tribunal mambo ni tofauti. you as the tenant you will ask to provide a time frame within which you shall pay for the rent and if you fail the Landlord then can proceed to evict you citing violation of the tribunal's orders

Even with a verbal month to month contract the landlord must give tenant a written 30 day notice. The landlord has a right to get their property back and no reason needs to be given. If the tenant doesn’t move out within 30 days the landlord must file for an unlawful detainer and have the tenant served. Once the tenant is served, a court date is set. If there are not any violations on the landlords part, the tenant will be made to vacate on the judges order.
