this is no different than what steam does. almost all PC gamers use steam and it has always requires online checkins.. and there's no retroactive change. it states it clearly when you agree to the new terms that it's for new purchases going forward so it's not as if it's hidden in any way. if you blindly click agree without reading it then that's a personal problem. and that's exactly what a judge will say

if you dont have or use wifi on your console and you play offline then how would you but digital? You would buy physical copies and be fine. Once you reconnect to wifi and login into your psn account you can play online. Not a big deal
