A written statement from Charlie Kirk's pastor led to a 35-minute argument about its admissibility on Tuesday, including whether it could be read aloud during the discussion and whether the discussion should be closed to the public. Judge Tony F. Graf Jr. in Utah's 4th Judicial District ultimately ruled that the statement from David Engelhardt could be cited and quoted as evidence but not read in its entirety. He did not close the discussion to the public. (You can watch the entire hour-long video on my YouTube channel or Facebook page.) The argument began with defense attorney Richard G. Novak saying the statement shouldn't be admitted as evidence in Tyler Robinson's preliminary hearing because it's irrelevant. Prosecutor Ryan McBride said the statement is evidence of "the defendant's motive, which is not an element of the defense, but nonetheless is powerful evidence, persuasive evidence, and two, it is relevant to the victim-targeting enhancement." McBride said the statement makes "clear that Charlie Kirk presented both religious and political arguments and positions in his presentations." "That is what paragraph three says, that he engaged others in tradition and debate, discussion of traditional family values, orthodox Christian views on sexuality, marriage, gender, sex, America's founding principles, political doctrines, and so forth," McBride said. Novak said "the state is bringing Matthew in through Mr. Engelhardt." "I didn't bring the Bible to this courtroom. The state brought it," said Novak, who is based in Pasadena, California. "And that concerns me greatly, because the state is turning this into a question of whether Mr. Robinson's views, identity, life are anti-Christian, and that's a huge problem, and the state has created that problem." Novak said the hearing "is being broadcast to the entire jury pool" and prosecutors are turning it "into whether Mr. Robinson's life is inconsistent with what Mr. Engelhardt calls orthodox Christian views." "I'm going to stop right here, because I think the court knows what the problem is," Judge Graf said. He said prosecutors can cite and quote Engelhardt's statement, but not in its entirety. "The court finds that it is relevant as it relates to the victim targeting enhancement, as it relates to Charlie Kirk's political expression," Graf said.
