It's not a court case. The house is tied up for approximately 4 to 6 month while your probate documents get approved, which grants the executor the right to disposed of the house and assets. You do pay probate fees. You save on a lot of legal and accounting fees to administer a trust. Only useful in a very limited amount of cases.

This isn’t for Canadians 🇨🇦 . Laws, tax consequences, trust rules and estate administration is very different in the US than Canada. In Canada, the second your investment property goes into a trust you have to pay taxes and for primary residence the property starts accumulating capital gains from the day it enters a trust. If you are concerned about the property post passing, then you can look at various testamentary trusts that are written directly in your Will. Don’t need a second document. The type of trust will depend on your specific objective. For instance, a spousal trust can give the benefit of the property to your spouse during their lifetime then have it passed to your kids. That way if your spouse remarries, the property is protected. Similar trust can be created for adult children to prevent their spouse from taking a part of it during divorce. Talk to an estate lawyer in your area for better guidance.

Please do your research!!! Probate is NOT that scary!!! For most states the title DEVOLVES (or passes) through the will and you just need to go to the revenue commissioner. I’m a probate & estate planning paralegal and know what I’m talking about. Not everyone needs a trust, a lot of times they’re just too complicated and can still be contested and become a “court case”. You can also have the deed titled as joint tenants WITH RIGHT OF SURVIVORSHIP, love how that’s not mentioned in this video, just the expensive and not necessary way (a trust)
