He repeatedly touched his ears, shifted in his seat, touched the back of his neck, and at times appeared visibly uncomfortable while answering questions. He also occasionally looked up and away while speaking. Now, does touching your ear or looking away automatically mean someone is lying? No. Body language by itself cannot establish deception. People under extreme stress, especially while discussing something traumatic, can display nervous movements and uncomfortable physical reactions without being dishonest. But when you’re watching testimony this closely, those behaviors can still raise questions. What makes them interesting isn’t one isolated gesture. It’s the pattern, timing, and whether those reactions changed when particular subjects or questions came up. And that’s where I think the audience has to pay attention. Don’t simply say, “He touched his neck, therefore he’s lying.” Instead ask: What was being asked at that exact moment? What was his answer? Did his behavior change when confronted with contradictory testimony or difficult facts? That’s far more meaningful than relying on a single supposed “lie detector” gesture. The Lindsay Clancy trial has now ended in a mistrial after the jury failed to reach a unanimous verdict, leaving the case unresolved. So the testimony, credibility questions, and conflicting interpretations of the evidence are still very much part of the conversation.
