Hemp-derived THC beverages that comply with federal law (like those allowed under the 2018 Farm Bill) can be legal to possess in Texas, even if they're open. That's where people get tripped up-because the container isn't always the issue. The legality depends on what's inside, how it's derived, and whether it falls within the permitted THC limits. Bottom line: not every open container in your car is automatically illegal in Texas, even though most people (and plenty of confident armchair lawyers) think it is. But don't get comfortable too fast-because this is where people end up in handcuffs. Even if the THC drink itself is legal to have open, you can absolutely still be arrested and charged with a DWI in Texas if you're impaired. Texas doesn't care whether the substance is alcohol, THC, prescriptions, or anything else—if it affects your normal use of mental or physical faculties while driving, you're at risk. So yes, the container might be legal... but driving while impaired is not. And that distinction? It's exactly where cases are won-or lost.
