Retired law professor that taught disability law. This situation is NOT an ADA issue, but covered under the Air Carrier Access Act of 1986 (It actually pre-dates the ADA). I do not have enough facts to fully answer whether this is a violation. However, if in fact another passenger was willing AND able to assist, that is problematic for the airline, but these cases are very fact specific. Unfortunately, it is not a clearcut violation.
