I think voting innocent is more morally correct, but voting guilty is funnier. If you were writing a sitcom episode where a character goes on trial, it’s funnier if they’re incorrectly convicted due to a twitter poll than if they walked free

Lawyer here, if he was empaneled and tweeted this, even during the trial, it would not rise to contempt unless he had been specifically told not to tweet throughout the duration of the trial, or if what he tweeted disclosed information that he was required to keep confidential under court rules as a juror. Even if he did this, the worst that would happen is that he’d get kicked off the jury and replaced with an alternate. I can see a universe where a defense attorney tries to use this tweet as the basis for an appeal but that is almost guaranteed to fail. Also, a lot of jury trials are civil trials so guilt or innocence doesn’t factor in at all.

I think the reason so many people's instinct when it comes to continuing the joke is to pick guilty is because it's funny to imagine that such a serious thing that can determine how someone's life goes is being decided by something silly like a Twitter poll, so they pick what they see as the more serious option.

I think what's funny is that he can't actually vote innocent. A jury only decides if the defendant is guilty or not guilty. So technically based on the poll the only option he can do is guilty.
