they need to request for an iep meeting to be had to discuss this service. Also request they put in writing why they are denying the child the service

A school can deny an IEP for a deaf student if the multidisciplinary team determines the hearing loss does not create an adverse educational impact, meaning the child is making adequate academic and functional progress without specialized instruction…they may still qualify for a 504 plan. Overall the school cannot deny services just because a kid “is doing well” but the service also needs to have an impact and not just a want…wording is also key in these meetings. Different states and even districts have different rules and funding limitations to also keep in mind.

They cannot deny her an IEP meeting. They don’t want to do it because it costs the school money. It’s a funding issue. There is paperwork online that she can get a template for and fill it out to make it personal. She’ll send that in to the school and school board if needed. It’s against the laws

The testing results will indicate needs that she has and what the school needs to do to give equal access to school and transportation. Legally unless it is a documented need They do not have to provide any additional resources. You have a IEP so that is why they worked with you.

Does your state have a mandate for reasonable accommodations? For example, in New York, if your district can't comply with what your child needs, they will create accommodations for your child. Maybe another district or placement in private school that the state pays for, or your health insurance pays for.

if she is on eip or 504 if it is on her paperwork they can't not deny the child I'd the child has plain eip and 504 plain if not in the plain I was the mom I guest a meeting make sure it is the child plan
