This EFF statement is more political than legal. President Ramaphosa has every constitutional right to approach the courts if he believes there are legal issues with the Section 89 report. That cannot suddenly become “delaying tactics” only because opposition parties don’t agree with him. Every South African has the right to seek judicial review, including the President. People must also stop acting like the Independent Panel found him guilty. The panel itself said it only found prima facie evidence for Parliament to consider further inquiry. That is not a final finding of misconduct or criminality. Also important, the Constitutional Court ruling was mainly about the parliamentary process followed in 2022, not about removing Ramaphosa from office. The Court did not impeach him, convict him, or declare him guilty. At the end of the day Parliament still makes the final decision, not the EFF, not social media, and not headlines. Even the impeachment committee recommendations are not binding on the National Assembly. Political parties are free to push their narrative, but constitutional processes must still be followed properly and fairly.
