@meghannmcuniff: A lawyer for the parents of two brothers killed by a speeding SUV driver questioned her boyfriend today about his alcohol consumption, including a martini he drank after court during jury selection in the wrongful death trial. Scott Erickson retired from Major League Baseball in 2006 after pitching 16 seasons for six teams. He was drinking with his girlfriend and his former MLB competitor Royce Clayton at a restaurant in Westlake Village on Sept. 29, 2020, when they left to make tacos at her home. Clayton was at a grocery store when Erickson and Grossman drove their Mercedes-Benz SUVs through the intersection of Triunfo Canyon Road and Saddleback Mountain Drive at 7:10 p.m. on Sept. 29, 2020, and Grossman struck 11-year-old Mark and 8-year-old Jacob Iskander in a marked crosswalk. Witnesses said the SUVs were speeding around 80 mph in the 45 mph zone and appeared to be racing. Grossman is in prison for second-degree murder. Prosecutors dismissed a misdemeanor reckless driving charge against Erickson after he recorded a public service announcement about safe driving. The boys' parents, Nancy and Karim Iskander, are suing Grossman and Erickson for wrongful death. Grossman's husband, Peter Grossman, a plastic surgeon whose father founded the Grossman Burn Foundation, also is a defendant because his wife's SUV was registered in his name. Erickson's lawyer said he was speeding only slightly and was not impaired. The Iskanders' lawyer Brian Panish questioned him early in direct-exam this morning about his penchant for alcohol, including a martini he was drank at a restaurant on Venice Boulevard one evening after court during jury selection. Erickson has not been in court every day, so Panish referred to "when you were here that day." "You were out drinking martinis after court on Ventura Boulevard, weren't you, sir?" Panish asked. "I had one martini," Erickson answered. "So after court, you went to the bar and were drinking martinis. Isn't that true?" Panish asked. "I had one martini," Erickson answered. "Is it true or not, sir, did you drink a martini while you were in court — right after court, you went and drank martini?" Panish asked. Judge Huey Cotton told Panish to rephrase after Erickson's lawyer Jeff Braun objected to the question as vague and ambiguous. "Is it true, sir, that you left court during jury selection, went right to the bar and drank a martini?" Panish asked. "Not straight to the bar," Erickson answered. "Oh, you waited. Where did you go in between?" Panish asked. "Back to my room," Erickson answered. "Back to your room. You changed and went and got the martini?" Panish asked. "I went for dinner," Erickson answered. "In fact, you had a Instagram picture with you holding a martini, right, sir? You posted that for the public. You in a tuxedo drinking martini, didn't you, sir?" Panish asked. Judge Cotton overruled an objection and Erickson asked Panish, "What are you talking about?" "Have you, sir, ever posted you in a tuxedo as the cover page of your Instagram, holding a martini glass, saying 'martinis life' something like that?" Panish asked.
