Defense attorneys kept their opening statements short today in the punitive damages phase of Nancy and Karim Iskander's wrongful death lawsuit against Rebecca and Peter Grossman and Scott Erickson. The jury on Wednesday awarded the Iskanders $176 million in compensatory damages for the Sept. 29, 2020, deaths of 11-year-old Mark and 8-year-old Jacob Iskander, who were struck in a crosswalk in Westlake Village by Rebecca Grossman in her Mercedes-Benz AMG. Jurors agreed Erickson and Grossman acted with malice and/or oppression (also fraud for Erickson), which opens them up to punitive damages. The jury is hearing testimony on Thursday and Friday, including from Peter Grossman. The Grossmans' lawyer Esther Holm gave a brief opening after the Iskanders' lawyer Brian Panish.

"The question that you're going to be deciding in this part of the case is whether additional amounts of money are necessary to punish Ms. Grossman's conduct. This phase is not against Dr. Grossman. This is for Rebecca Grossman's conduct, and as the court has instructed you, there is no fixed formula." "This is for you to decide whether or not you think there is a requirement that you need to award more damages, and what those, what that amount would be, the amount must be reasonable, proportional, and it needs to be based on the evidence." “You're going to hear some evidence about Mrs. Grossman's employment history and her ability to work. The evidence will show that she has not earned income for many years since this accident, and prior to this accident. The evidence will show that Ms. Grossman, in the years prior to the accident, was doing charity work. She was not being paid for work that she did with Afghanistan children and people who had been suffering burn injuries."
