You’re focusing on the optics however the legal precedent is shaky. If OpenAI was a nonprofit why was there a discussion of ownership as if there was equity to be had. It either means that they had known all along OpenAI wouldn’t be a nonprofit. However even if they knew the current structure of OpenAI would almost guarantee Musk a loss. Musk gave money to the nonprofit and even though he expected 90% the structure doesn’t allow it at the time and he knew. He could’ve asked for his money back but he walked away. Now the nonprofit arm owns part of a for profit but it doesn’t make the nonprofit any different from when Musk walked away.
