I don't know what state this is in but in Ohio where I'm at you're not required to hand it over you must display it the law is clear Ohio Revised Code (ORC) 4507.35(A) states: "The operator of a motor vehicle shall display the operator's driver's license, or furnish satisfactory proof that the operator has a driver's license, upon demand of any peace officer..." It further notes that if you have the license on you, you shall not refuse to display it. Failure to do so can result in a misdemeanor citation.45ff59 "Display" generally means showing it clearly so the officer can read/verify the details (name, photo, expiration, etc.).

In Florida, you cannot simply hold your driver's license up to the window; you are legally required to physically hand it over to the police officer. The Law: Florida Statute 322.15 Under Florida Statute 322.15, any person operating a motor vehicle must have their license in their immediate possession and must "present or submit the same upon the demand of a law enforcement officer." Why "Showing" It Isn't Enough • Legislative Change: In 2014, the Florida legislature intentionally changed the wording of this statute from requiring a driver to "display" the license to requiring them to "present or submit" it. This amendment was specifically enacted to mandate the physical surrender of the document to the officer, closing the loophole of simply showing it through a closed window. • Inspection Requirements: The statute explicitly mandates that the license must be "fully legible with no portion of such license faded, altered, mutilated, or defaced." Case law and guidance from Florida State Attorney's Offices maintain that officers must be given the physical card to verify its authenticity and condition, which cannot be adequately done through glass. Consequences of Refusal Refusing to physically hand over your license constitutes a failure to comply with the statute. Officers can escalate the situation, which may lead to: • Arrest and Criminal Charges: You can be charged with Resisting an Officer Without Violence or Obstruction of Justice (Florida Statute 843.02), which is a first-degree misdemeanor. • Prolonged Detention: Refusal to cooperate extends the duration of the stop and gives the officer grounds to detain you further until your identity and driving privileges are fully verified.

An officer who pulled my son over, left in the middle of the stop for another call and took his license with him. leaving him stuck there. his dad and I had to go down there and call dispatch requesting the officer return with his license. he gave us a hard time. sorry but that was a bit ridiculous to me so I can sort of understand although it probably doesn't happen often.
