UNHCR کیسز میں بڑی خوشخبری، ہزاروں افغان خاندانوں کے لیے اہم قانونی ریلیف UNHCR Cases Update | Detailed Judgment Issued الحمدللہ، پشاور ہائی کورٹ نے UNHCR سے متعلق تقریباً 140 Constitutional Petitions میں اپنے پہلے جاری کردہ Short Order کے بعد اب Detailed Judgment بھی جاری کر دیا ہے۔ یہ تمام مقدمات ان افغان خاندانوں اور افراد سے متعلق تھے جنہوں نے UNHCR کے ذریعے International Protection، Refugee Status Determination (RSD) یا Third Country Resettlement کے لیے درخواستیں دے رکھی ہیں اور انہیں افغانستان واپسی کی صورت میں اپنی جان، آزادی اور بنیادی انسانی حقوق کو سنگین خطرات لاحق ہیں۔ Honourable Peshawar High Court has held that the Federal Government is under a legal obligation to examine each case individually and decide, in accordance with law and the principle of Non-Refoulement, whether the applicant is entitled to Asylum, Temporary Stay, Sojourn or a Residence Permit. عدالت نے واضح کیا ہے کہ ہر کیس کا فیصلہ اس کے اپنے حقائق اور میرٹ پر کیا جائے گا اور کسی بھی درخواست گزار کو بغیر قانونی جائزے کے ایسے ملک واپس نہیں بھیجا جا سکتا جہاں اسے persecution، torture، death یا دیگر سنگین انسانی حقوق کی خلاف ورزیوں کا حقیقی خطرہ ہو۔ یہ فیصلہ نہ صرف ہزاروں افغان خاندانوں کے لیے امید کی ایک نئی کرن ہے بلکہ پاکستان میں Refugee Law، Human Rights اور International Law کے اصول Non-Refoulement کی توثیق بھی کرتا ہے۔ I had the honour of representing the petitioners before the Honourable Peshawar High Court. The issuance of the Detailed Judgment provides important legal guidance for all pending and future UNHCR-related matters and strengthens the protection available to Afghan refugee families seeking lawful protection in Pakistan.
