I find it bizarre that a law firm would seem to be ignorant of the practicalities around the "proportionate way of achieving a legitimate aim" defence. My guess is that they only ran it as an afterthought once the claim had been lodged, rather than actually considering it at the time.✌️🫶

What is strange is that the court can decide that having an age policy can be legal for certain jobs, yet the same dosent apply to pensions. So a person can be forced to retire from a job before state retirement age but not be able to get access to a pension.
Theoretically that policy could even apply at an age before they could even access a private pension.
