Retired Major League Baseball pitcher Scott Erickson's lawyer Jeff Braun suggested in his closing argument on Monday that jurors award the Iskander family $10 million. Erickson was speeding near his girlfriend, Rebecca Grossman, on Sept. 29, 2020, in Westlake Village, California, when Grossman hit and killed brothers Mark and Jacob Iskander in a crosswalk. Braun told the jury their instructions provide "no method" to assign a "dollar figure" to the Iskanders' "unimaginable loss." The Iskanders' lawyer Brian Panish "gave you an itemization of each element, society, love, companionship" but "that's not what this verdict form does," Braun said. "It's not asking you to value each element of that loss. It's asking you to evaluate the loss as a whole for companionship, comfort, care, assistance for both parents," Braun said. Braun said Panish "threw a number at you of $300 million this morning." Panish's suggested damages actually totaled close to $439 million: $14 million and $250 in past damages for each boy, $111 million in future damages for each and $60 million in emotional distress damages for Zachary Iskander and $100 million for Nancy Iskander. Braun told the jury Panish suggested a big number partly "to try to set the bar where whatever you do less than that will potentially be acceptable." "You need to start at zero and work your way up to what you believe this loss is worth. What does this family deserve for the loss of their children? I propose to the evidence suggests that a reasonable sum for this loss to this family is $10 million dollars, and I think it would give them the opportunity to do the things that they think they could do to move their vet life forward," Braun said. Jury deliberated until 3:30 p.m. on Tuesday (June 2) and are back deliberating today. Judge Huey Cotton granted Panish's motion for directed verdict on the negligence and causation claims against Grossman, so jurors only need to decide damages against her. On Tuesday afternoon, the jury asked for the suggested damages figures from closing arguments, and the judge gave them to them.
