The Court of Appeal in Abuja on Monday upheld the Federal High Court order restraining INEC from recognising state congresses conducted by committees appointed by the Senator David Mark-led caretaker leadership of ADC. In a 2-1 majority decision in appeal CA/ABJ/CV/608/2026, Justice Okon Abang affirmed the April 29 judgment of Justice Joyce Abdulmalik, which barred caretaker leadership from interfering with the tenure of elected state executive committees. Justice Donatus Okorowo concurred, while Presiding Justice Abba Mohammed dissented, saying the matter was an internal party affair. Justice Abang held that the authority to conduct state congresses rests with elected state EXCOs, not the caretaker national leadership, stressing, “Once complaint is anchored on constitutional infraction, shield of internal affairs drops.” Court said intervention was to “prevent anarchy and ensure survival of democracy,” citing Supreme Court PDP precedent. The court ruled congresses and national convention conducted by Mark-led caretaker were nullities, held in defiance of subsisting April 14 order, and awarded N10m costs against ADC. Decision casts doubt on validity of congresses through which several candidates including former VP Atiku Abubakar emerged ahead of 2027. Suit FHC/ABJ/CS/581/2026 was filed by Don Norman Obinna and 6 others on behalf of all state chairmen, challenging caretaker’s appointment of congress committees as violation of party and 1999 Constitutions.
