The judge in the case against the man accused of murdering Charlie Kirk ruled today (Friday, March 13) that filings seeking the removal of cameras in the courtroom should not be sealed from public view. The filings right now aren't available publicly, but Judge Tony F. Graf, Jr. ordered Tyler Robinson's lawyers to file a public version of their motion by March 30. They are to redact private information for potential witnesses that attorneys cited as an example of the problems arising from extensive pretrial publicity. "The court is sensitive to the amount of pretrial publicity generated by this case, including an extensive amount of public commentary and inaccurate or conspiratorial descriptions of alleged evidence supporting or negating defendant's guilt. A substantial amount of this pretrial publicity is organized and memorialized into defendant's motion, because the references to pretrial publicity are, by their very nature, already contained in the public arena. Interest favoring closure are greatly diminished," the judge said. "If no redacted motion is filed by that time, the court will reclassify docket 305 as public. If a redacted motion is filed, the court will maintain the private classification on docket 305," Graf continued. Graf didn't give the same leeway for the defense's reply brief. He said the motion to seal it "does not cite any part of the reply memorandum that references potentially prejudicial information." "Based on the record before the court concludes that defendant has not provided a sufficient basis for the court to find the interest favoring closure outweigh interest favoring access to the reply memorandum as such, defendant's motion is respectfully denied," Graf said. Graf is a former city councilman in Toole, Utah, who earned his juris doctor at the University of Utah College of Law. He was a deputy prosecutor in Davis, Utah and Salt Lake counties before Gov. Spencer Cox appointed him to the Fourth Judicial District bench in May 2025. He's made clear through his rulings in Robinson's case that he favors public access to the proceedings. In February, he rejected prosecutors request to seal the identify of Chad Grunander, the chief deputy prosecutor whose daughter attended the Utah Valley University event at which Kirk was shot and killed. Robinson's attorneys wanted Graf to remove the Utah County Attorney's Office from the case because of Grunander' daughter's attendance, but Judge Graf declined to do so after hearing several hours of testimony. Robinson is accused of fatally shooting 31-year-old Kirk on Sept. 10, 2025, when Kirk was at Utah Valley University in Orem for an event with his Turning Point USA group. He is charged with seven crimes: aggravated murder, a first-degree felony; discharge of a firearm, a first-degree felony; two counts of obstruction of justice, second-degree felonies; two counts of tampering with a witness, third-degree felonies; and a misdemeanor count of violence committed in the presence of a child.
