legally speaking the ring is not an unconditional gift unless it was given as such on a holiday such as valentines day or christmas (and not just as a proposal). In most states the ring is a no-fault conditional gift that would be returned to the giver upon a broken engagement (regardless of fault). In some other states its a "at-fault" gift and ownership is given to the person who is NOT at fault for the broken engagement. If the ring is a family heirloom it is almost always given back to the original owner of the ring upon a broken engagement.
