Kouri Richins' housekeeper Carmen Lauber returned to the witness stand in Richins' murder trial on Monday to answer questions about violating her probation in November 2023. Lauber is a key prosecution witness because she testified she got Kouri the pill believed to contain fentanyl that Kouri used to poison her husband, Eric Richins, in March 2022. Richins’ lawyers want to discredit Lauber any way they can, so they’ve focused on her probation violations to try to cast her as a dishonest person. She testified earlier in trial, but prosecutors recalled her as a witness this week to let Richins' lawyers ask her more questions after they complained they'd have to call her as a witness in their own case to ask her about the November 2023 probation violations, which the defense said they learned about through a subpoena and qualifies as
Kouri Richins' housekeeper Carmen Lauber returned to the witness stand in Richins' murder trial on Monday to answer questions about violating her probation in November 2023. She testified earlier in trial, but prosecutors recalled her as a witness this week to let Richins' lawyers ask her more questions after they complained they'd have to call her as a witness in their own case to ask her about the November 2023 probation violations, which the defense said they learned about through a subpoena and qualifies as "new information." Lewis asked Lauber about a detective seeing her at a concert with alcohol in October 2023. “I went there with a bunch of friends and my buddy who bought me the ticket. I asked him if I could pay him back. He said, ‘No, you could just buy the drinks and snacks,’” Lauber testified. “Alright. And you drank the drinks also?” Lewis asked. “No, I did not,” Lauber answered. “Well. So you were seen at the concert by a detective from the Summit County police, unfortunately?” Lewis asked. “Yes, correct,” Lauber answered. “And you had alcohol in your hand, correct?” Lewis asked. “Correct,” Lauber answered. Lewis and Lauber went back and forth about whether she actually drank alcohol, so Lewis showed Lauber her probation report. “Does that remind does that refresh your recollection as to what you told Detective Mainord?” Lewis asked. “No, I don't recall, but if it's there, I guess so,” Lauber answered. “So you did tell Detective Mainord you actually drank alcohol, correct?” Lewis asked. “I don't recall, but if it's there, I guess so,” Lauber answered. “Okay, so if Detective Mainord said that you admitted that to him, that's true?” Lewis asked. “Yes,” Lauber answered. Lewis also questioned Lauber about violating her 9 p.m. curfew. “I don't recall if I stayed the whole concert. I did not stay the whole concert. I left early, so I was home at 9 o'clock. Probably not exactly at 9,” Lauber answered. “You don't admit that you violated your curfew?” Lewis asked. “Yes, I do,” Lauber answered. “You did violate your curfew?” Lewis asked. “Yes, I said I did not stay the whole concert,” Lauber answered. “Okay. So the reason that you were discovered in violation is because an officer saw you, correct?” Lewis asked. “Correct,” Lauber answered. “Or you would have no one would have ever known, correct?” Lewis asked. “I’m not too sure. …I had an ankle monitor on. They would know where I was at,” Lauber answered. “But they wouldn't know you were drinking?” Lewis asked. “No,” Lauber answered. “So you just happened to be caught on this occasion, correct?” Lewis asked. “Correct,” Lauber answered. Jurors have heard all testimony after Richins declined to testify on Thursday. Attorneys and Judge Richard Mrazik are to meet at 1 p.m. MST today to finalize jury instructions. Jurors are to report to the Silver Summit Justice near Park City on Monday at 8:30 a.m. for closing arguments. #law #crime #court #probation #attorney
