If the owner gets into the accident they can take everything the business has but also everything the owner personally has, the LLC and INC only really protects the owner if the owner was not involve. Same concept if a tree falls on your clients house that your working on owner's screwed if he did it but if it was an employee they can only take the company and the assets.
Big downside to placing a vehicle in an LLC or INC when buying new is the lemon law is greatly reduced, you have a lot more protection if its in your name vs the company's.
You still are able to get the benefits of the tax brakes if its in your name, you just have to prove it was used for work
