@meghannmcuniff: An engineer on Tuesday disputed the safety of the intersection in Westlake Village, California, where a speeding SUV driver killed two boys in a crosswalk in 2020. In cross-exam, a lawyer for the boys' parents asked if he'd read the driver's deposition. "I believe I did," said Andrew Kwasniak, a consultant with Tatum Group. "You did. So, how fast does she say she was going when you read her deposition?" asked attorney Brian Panish. "I don't recall the exact speed she was testifying," Kwasniak answered. "Well, what was the range of the speed she testified she was going?" Panish asked. "Again, I don't remember how fast her speed was," Kwasniak answered. "Did she say where she was going in her deposition?" Panish asked. "I don't recall. As a traffic engineer, I don't recall," Kwasniak answered. "What else did you see in her deposition when you read it all? You billed them for the time to read it, didn't you?" Panish asked. "I bill for my time, yes," Kwasniak answered. "Okay. Well, did you know that Rebecca Grossman didn't give a deposition in this case about the facts in the accident. Did you know that?" Panish asked. "That's why I say I don't recall," Kwasniak answered. "Well, you just told us you read it. You'd be wrong, wouldn't you? Because if she never testified about it, there would be nothing for you to read, would there?" Panish asked. Los Angeles County Superior Court Judge Huey Cotton told Panish to let Kwasniak finish his answer. "So, what I said, I don't recall if this was the case," Kwasniak said. #law #crime #court #driving
