When a car in front of you slows down you dont immediately overtake even in a case where its slowing down to turn and has indicated. You establish a reason why. maybe there is a pedestrians suddenly emerging, a tree on the road,another car or a sinkhole. The motorbike guy is 100% wrong.

Under the road and traffic act, whoever is on the main road has the right of way regardless of the lane. Since the Mitsubishi driver didn't yield for incoming traffic and decided to join the road amidst noticing incoming traffic, it makes him liable.

The one driving ahead of them should have put the right indicator on to signal those behind not to overtake but this is just a courtesy technique.
