I disagree- Patagonia was extremely respectful and supportive of Patti Gonia in their communications (from the court documents), but made it clear that Patti can not use Patagonia’s logo or block white lettering when selling/promoting merchandise. If Patagonia DOESNT sue to protect their trademark, they lose it. The Jan Sport situation you mentioned was a collab- but if Jan Sport trademarked Jan Sport in the athletic/outdoors industry, that would be infringement. When she sells merch, she sells it under her “Jan” trademark. The same way Trixie Mattel sells items under her “Trixie” trademark, because using the Mattel name to sell toys/trinkets would be infringement. I’d recommend reading the court docs for more context!

All these comments are sooo misinformed about the terms of the lawsuit, and what Pattie actually did, which was directly go against the agreement that she had with Patagonia: that they were cool with her doing her thing unless she made merch with their logo/similar to their logo, which she did. That’s just basic trademark law y’all, they have to protect their brand and have tried to communicate with her so it didn’t come to having to sue. They’re also suing for $1 which shows that they’re not just after money. The legal fees part is unfortunate, but she did directly go against the agreement they had, so it could have been avoided if she hadn’t infringed on their agreement. Doesn’t seem like they want to sue at all, but trademark law says they have to affirmatively protect their brand against anyone and everyone who infringes upon it, they cannot pick and choose who to sue. Seems like they tried to deescalate it first, and Pattie didn’t back down. Please watch actual lawyers’ videos about this topic instead of allowing Pattie to win the court of public opinion like she’s attempting to do, because she knows she is not going to win this lawsuit.

Trademark law protects all companies, small or big. I don’t like defending big companies but they’re well within their right to sue her. She used a very similar name, likeness and branding within the exact same nice. If Jan sport started selling backpacks with ‘Jan *space* Sport’ she almost def would’ve gotten sued. But she never attempted to, which is why she never got sued. Pattie started selling merch with the exact same color scheme and likeness as Patagonia. Trademarks are meant to protect small businesses. I love what Pattie stands for, but this whole situation feels like a preventable IP mess. Patagonia is doing what big brands always do with trademarks: if they don’t enforce, they risk losing strength later. Pattie’s team seems to have treated this more like playful homage than a serious legal line, and then doubled down with a trademark move that gave Patagonia the perfect opening to act. I can support the advocacy and still think the strategy here was not thought through.
